Terms of Use

These terms govern your use of the WIA Performance website. Separate agreements may govern training, memberships, registration, and purchases.

1. Acceptance and scope

These Terms of Use (“Terms”) apply to the website operated by WIA 2123 LLC, doing business as WIA Performance (“WIA,” “we,” “us,” or “our”). By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

These Terms govern the website itself. Registration agreements, participation waivers or releases, membership terms, and purchase, cancellation, or refund policies presented by WIA or through WellnessLiving separately govern the applicable service or transaction. If a separate agreement conflicts with these Terms on a service or transaction-specific issue, the separate agreement controls that issue.

2. Eligibility and minors

You must be legally capable of agreeing to these Terms. If you use the website for a minor athlete, you represent that you are the athlete’s parent or legal guardian, or otherwise have authority to provide information and make decisions for that athlete. Parents and guardians are responsible for supervising minors’ use of the website and reviewing all applicable service agreements and waivers.

3. Website use

The website provides general information about WIA, its locations, training programs, schedules, memberships, promotions, and ways to contact or register with us. You may use it only for lawful, personal, and legitimate business purposes.

You may not:

  • Use the website in a way that violates law, infringes another person’s rights, or harms WIA, its customers, or others.
  • Attempt to gain unauthorized access to accounts, systems, data, or restricted parts of the website.
  • Interfere with the website’s operation, security, or availability, including by introducing malicious code or excessive automated traffic.
  • Misrepresent your identity, authority, or affiliation, or submit information you are not authorized to provide.
  • Copy, scrape, reproduce, or commercially exploit website content except as permitted by law or with WIA’s written permission.

4. WellnessLiving and third-party services

WIA uses embedded WellnessLiving tools and links for lead capture, account creation, scheduling, registration, memberships, and payment processing. Your use of WellnessLiving and other third-party platforms is also governed by their separate terms, privacy policies, and transaction rules. Review those terms before submitting information or completing a purchase.

WIA does not control and, except to the extent required by applicable law, is not responsible for the availability, performance, security, or independent conduct of third-party platforms. Links to third-party services do not imply responsibility for all content or practices on those services.

5. Bookings, memberships, and purchases

Prices, booking terms, membership periods, automatic-renewal terms, cancellation requirements, refund eligibility, rescheduling rules, and other transaction details are governed by the terms and policies displayed at checkout, applicable WIA policies, and any separate agreement you accept. You are responsible for reviewing those terms before registering or purchasing.

Website descriptions and availability may change. If general website content differs from the terms shown at checkout or in a signed or accepted agreement, the checkout terms or separate agreement control the applicable transaction.

6. Health and training disclaimer

Exercise, athletic training, recovery activities, and sports participation involve inherent risks, including the risk of injury. Website content is provided for general information and is not medical advice, diagnosis, or treatment. Consult a physician or other qualified professional when appropriate, including before beginning a new training or recovery program or if an athlete has an injury, medical condition, or health concern.

Separate participation waivers, releases, health acknowledgments, or facility rules may apply to WIA services. These Terms do not replace those documents and do not create a blanket waiver of responsibility for participation injuries.

7. Intellectual property

The website and its branding, names, logos, text, photography, video, graphics, design, and other content are owned by WIA 2123 LLC or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, WIA grants you a limited, revocable, nonexclusive right to access and use the website for personal, noncommercial purposes. No other rights are granted.

8. Submissions and communications

If you send WIA an inquiry, feedback, athlete information, or another communication, you represent that you have the right to provide it. You give WIA a limited permission to use, reproduce, transmit, and share that content only as reasonably necessary to respond, provide requested services, operate our business, comply with law, or protect rights and safety. You retain ownership of content you submit; these Terms do not transfer broad ownership of your content to WIA.

9. Disclaimers

To the extent permitted by applicable law, the website and its general informational content are provided “as is” and “as available.” WIA does not guarantee that the website will always be uninterrupted, error-free, or current, or that every program, schedule, price, or promotion will remain available. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the extent permitted by applicable law, WIA will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of, or inability to use, this website. Any liability that cannot lawfully be excluded or limited remains subject to applicable law. This section does not claim blanket immunity for injuries arising from participation in WIA activities; those matters are addressed by applicable law and any separate participation agreement or waiver.

11. Indemnification

To the extent permitted by applicable law, you agree to defend and indemnify WIA and its personnel from third-party claims, losses, or expenses arising from your unlawful misuse of the website or your material violation of these Terms. This obligation does not apply to claims caused by WIA’s own conduct to the extent responsibility cannot lawfully be shifted.

12. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to applicable law, disputes relating to these Terms or the website will be brought in a court of competent jurisdiction in Texas.

13. Changes and termination

We may update these Terms from time to time by posting the revised version and changing the “Last updated” date. Your continued use of the website after an update means the revised Terms apply to later use. WIA may suspend or terminate access to the website when reasonably necessary for security, maintenance, unlawful conduct, or violation of these Terms.

14. Severability and entire agreement

If a provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in effect. These Terms and the Privacy Policy form the entire agreement concerning use of this website, while separate registration, participation, membership, and transaction agreements continue to govern their respective services.
